Terms of Service

Swish Picks is owned and operated by StatSight LLC, a Virginia limited liability company ("Swish Picks," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of swishpicks.co and any related apps, emails, and services (together, the "Service").

By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Swish Picks provides NBA statistics, player projections, modeled probabilities, matchup context, and related research tools.

We are not a sportsbook. We do not accept, place, or process wagers, hold funds, or pay out winnings. We do not receive payment from sportsbooks for referrals. Some pages show betting lines and odds published by sportsbooks so you can compare them with our projections.

Nothing on the Service is betting, financial, or professional advice. Projections, "chance" figures, Swish Scores, and similar outputs are statistical estimates produced by models from historical data. They are often wrong. A modeled chance is not a guarantee, and past results do not predict future results.

You are solely responsible for your decisions, including any decision to place a wager, and for making sure that any betting you do is legal where you are.

You must be at least 21 years old, and old enough to enter into a binding contract where you live, to use the Service. By using the Service you represent that you meet these requirements. We may close accounts we reasonably believe belong to someone under 21.

Swish Picks is independent. We are not affiliated with, endorsed by, or sponsored by the National Basketball Association, any NBA team, the NBA Players Association, FanDuel, DraftKings, ESPN, Sports Reference, or any other league, team, sportsbook, or data provider. Team names, player names, logos, and other marks belong to their respective owners and are used only to identify the teams, players, and lines being described.

The Service is built from publicly available information, including box scores and play-by-play data published by NBA.com and ESPN, injury and roster news, and betting lines and odds from sportsbooks such as FanDuel and DraftKings, which we receive from a third-party odds data provider (currently The Odds API).

Data can be late, incomplete, or wrong. Lines and odds shown on Swish Picks may not match what a sportsbook is currently offering. Injury and lineup information can change right up to tip-off. Always check the sportsbook and official sources before acting. We do not guarantee that any information on the Service is accurate, complete, or current.

• You must give a valid email address you control.
• You are responsible for keeping your password confidential and for activity under your account.
• Accounts are personal. Do not share your login or let others use your subscription.
• Tell us promptly at support@swishpicks.co if you believe your account has been accessed without permission.

Some parts of the Service are available without an account. Others require a free account or a paid Swish Pro subscription.

The features included in the free plan and in Swish Pro are described on our upgrade page. That page controls over any older description in emails or elsewhere. We may add, change, or remove features of either plan over time. If we remove a major Pro feature, we will tell you, and you may cancel.

8.1 Price

Swish Pro is currently $10 per month ("Founder's Price"). Prices are in U.S. dollars unless checkout shows a different currency. Applicable taxes may be added. Your bank may charge foreign transaction or conversion fees.

Founder's Price: if you subscribe at the Founder's Price, we will not raise the monthly price of that subscription for as long as it stays active without a lapse. If your subscription ends for any reason (including cancellation or unresolved failed payments) and you subscribe again later, the price then in effect applies. We plan to charge a higher price to new subscribers in the future.

8.2 Free Trial

Eligible new subscribers get a 7-day free trial. A trial is available once per account; accounts that have subscribed before are not eligible. A valid payment method is required to start a trial. Unless you cancel before the trial ends, your subscription will start automatically and your payment method will be charged the monthly price. We aim to email you a reminder before the trial ends, but you are responsible for canceling in time.

8.3 Automatic Renewal

Swish Pro renews automatically every month and your payment method is charged in advance at the start of each billing period until you cancel. You authorize us and our payment processor, Stripe, to charge your payment method for each renewal.

8.4 How to Cancel

You can cancel at any time from your account page by selecting "Manage Subscription," or by emailing support@swishpicks.co. When you cancel:

• You keep Pro access until the end of the current billing period (or the end of your trial).
• You will not be charged again.

8.5 Refunds

If you cancel during your free trial, you are not charged. Otherwise, payments are non-refundable and we do not give partial refunds for unused time, except for billing errors or where the law requires a refund. If you think you were charged in error, email us within 60 days of the charge.

8.6 Failed Payments

If a payment fails, Pro access is paused until the payment goes through. Our payment processor will retry the charge. If the payment is not resolved after those retries, your subscription may be canceled.

8.7 Price Changes

Except for the Founder's Price promise above, we may change subscription prices. We will email you at least 30 days before a price change takes effect on your subscription, and you can cancel before it does.

Payments are processed by Stripe, Inc. We do not receive or store your full card number. Your use of Stripe is also subject to Stripe's terms.

You agree not to:

• Use bots, scrapers, crawlers, or other automated means to access or copy the Service or its data.
• Bypass or try to bypass paywalls, usage limits, rate limits, or other access controls.
• Resell, redistribute, publish, or commercially exploit content or data from the Service, including Pro content.
• Share your account or Pro access with others.
• Use the Service for anything illegal, including illegal gambling.
• Interfere with, disrupt, or probe the security of the Service.
• Impersonate anyone or misrepresent your affiliation with anyone.
• Upload or transmit malware or other harmful code.

The Service, including its software, models, Swish Scores, projections, design, and text, is owned by Swish Picks or its licensors. Underlying facts and statistics are not claimed as ours. Third-party marks and content belong to their owners.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer it, except where the law expressly allows.

If you send us feedback or suggestions, we may use them without any obligation to you.

The Service may link to or rely on third-party websites and services. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any projection or probability will be accurate.

To the fullest extent permitted by law, StatSight LLC and its members, managers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, gambling or wagering losses, lost data, or loss of goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility of those damages.

Our total liability for all claims related to the Service or these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) $50.

Some jurisdictions do not allow certain of these limits, so they may not fully apply to you.

You agree to defend and indemnify StatSight LLC and its members, managers, and contractors against any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these Terms or the law.

Informal resolution first. Before filing a claim, you agree to email support@swishpicks.co with a description of the dispute and try to resolve it with us informally for at least 30 days. We will do the same before filing a claim against you.

Binding individual arbitration. If we cannot resolve it, any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be conducted by video or phone. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek an injunction in court to stop infringement or misuse of intellectual property.

Class action waiver. You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt out. You may opt out of this arbitration agreement by emailing support@swishpicks.co within 30 days of first creating your account, with the subject line "Arbitration Opt-Out" and the email address on your account. Opting out does not affect any other part of these Terms.

If this arbitration agreement is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Virginia, and you and we consent to personal jurisdiction there.

These Terms are governed by the laws of the State of Virginia and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules.

You may stop using the Service at any time and may ask us to delete your account. We may suspend or end your access if you violate these Terms, if we are required to by law, or if we stop offering the Service. If we end a paid subscription for reasons other than your violation of these Terms, we will refund the unused portion of your current billing period. Sections that by their nature should survive termination will survive.

We may update these Terms. We will post the updated Terms here with a new "Last Updated" date, and for material changes we will also notify you by email or in the Service before they take effect. Continuing to use the Service after changes take effect means you accept them.

Betting involves real financial risk. Never bet more than you can afford to lose, and do not treat betting as a way to make money.

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization.
